The State of Tennessee filed a consumer protection lawsuit against HRC for alleged misrepresentations it made in its advertising and sale of bio-identical hormone replacement therapy. The Tennessee Attorney General learned of complaints against HRC, including complaints lodged with the Division of Consumer Affairs, alleging deceptive sales practices related to HRC’s advertising to Tennessee consumers.
An investigation by the Attorney General concluded that HRC’s conduct had violated the Tennessee Consumer Protection Act (TCPA), and in particular, that HRC had, at times, made false and misleading statements in the commercial marketplace, and materially omitted information about the safety, efficacy, benefits, side effects and risks of bio-identical hormone replacement therapy. The State filed a lawsuit against HRC and its owners in the Davidson County Circuit Court alleging violations of the TCPA. The State’s lawsuit did not include medical malpractice claims as the State could not bring those types of claims on behalf of consumers.
The Davidson County Circuit Court found that HRC deceived Tennessee consumers in violation of the TCPA and lodged a consumer redress award of $18,141,750.00 against HRC, based on the total number of Tennessee consumers and average purchase price of one year of bio-identical hormone replacement therapy treatment.

The State has attempted to collect every known available asset of the Defendants to satisfy as much of the judgment as possible. However, the total restitution fund available to satisfy all Tennessee consumer claims is approximately $1.5 million, so the restitution fund will likely not be sufficient to compensate all valid claims in full. The amount of financial restitution received depends on the number of claims filed. Because the State’s judgment was based on the average purchase price of one year of bio-identical hormone replacement therapy, the maximum recovery is capped at $2,250.00. The more claims that are submitted, the lower the individual recovery amount will be. Recovery does not reflect compensation for any medical injuries you may have incurred.
